The Supreme Court is the arbiter of so many of the rights essential to women and girls, and if confirmed Judge Kavanaugh will have a say in those decisions for decades to come. But Judge Kavanuagh’s record shows that he is willing to do grave harm by undermining positions central to our mission, including upending employment and labor rights, opposing reproductive rights and access to healthcare, entangling public education and religion, and restricting voting rights.
Since 2011, politicians in 33 states have passed 401 new laws against abortion that shame, pressure, and punish women who decide to have an abortion. At least 20 states including Wisconsin are poised to immediately work to ban abortion if Roe v. Wade were overturned. Judge Kavanaugh has shown opposition to women’s access to reproductive health care and contraception, seeking to delay a woman’s access to an abortion, arguing in support of religious employers who obstruct their employees’ access to contraceptive coverage, and calling into question protections of the Affordable Care Act. We should expect, based on his record, that he would be willing to severely weaken or overturn Roe v. Wade.
Further, Judge Kavanaugh has shown little support for workers’ rights, including low wage workers and workers of color. While on the bench, Judge Kavanaugh argued to weaken protections for race and age discrimination, and routinely argued to limit workers’ rights to organize and to narrow the scope of our labor laws. Judge Kavanaugh also has a record of limiting access to the ballot box.
Senate confirmation of Judge Brett Kavanaugh would be a tremendous and enduring setback for women and for all of us who care about protecting women’s health and rights. President Trump chose Judge Kavanaugh because of his opposition to Roe v. Wade and his willingness to gut or eliminate the Affordable Care Act, which would leave millions more people uninsured and would destroy critical protections, such as requiring coverage for pre-existing conditions and maternity care.
